It’s war.
That’s right. The IRS is waging war against improper ERC claims. (Employee Retention Credits.)
The result? Many tax professionals are becoming overly conservative with their past, current, and future filings for 2020 and 2021 employee retention credits.
And no wonder, The IRS is putting out a barrage of negative information and intimidation that scares many tax professionals and business owners.
But here’s the deal: don’t be afraid of legitimate ERC claims.
Two important points,
- If your ERC claim is legitimate, be patient. Also, make sure you have the documents to back up your claim. Frankly, you should have had the documentation before you filed for the ERC.
- If your ERC is not legitimate, review the possibilities in IR-2023-169 and discuss them with your tax professional.
Why is the IRS being so tough?
Yes. The ERC is a legitimate tax credit. But the IRS notes that as time passes, the credit has been increasingly the target of aggressive marketing to businesses that may not qualify for the credit. Thus, the crack down on ERC filings.
